Welcome to HUMMED ("we," "us," or "our"). HUMMED is a sound therapy mobile application (the "App") operated by Hummed LLC, located at 850 Siskiyou Blvd STE 3, Ashland, OR 97520. This Privacy Policy explains how we collect, use, store, share, and protect your personal information when you use the HUMMED App and any related services (collectively, the "Service").

By downloading, installing, or using the App, you agree to the practices described in this Privacy Policy. If you do not agree with any part of this policy, please do not use the App.

This Privacy Policy applies only to information collected through the HUMMED App. It does not apply to information collected by any third party, including through any application or content that may link to or be accessible from the App.

Information We Collect

We may collect the following types of information:

Information You Provide Directly:

• Account registration details (e.g., name, email address, password)

• Payment and billing information (processed securely through Stripe)
• Communications you send to us (e.g., support requests, feedback)

• Location data (general location derived from IP address only; we do not collect precise GPS location)

• If you sign in using a third-party account (e.g., Google, Apple ID), we may receive your name and email address as permitted by that service

How We Use Your Information

We use the information we collect for the following purposes:

• Providing and improving the Service: To deliver sound therapy content, personalize your experience, and improve app features

We do not sell your personal information. We may share your information only in the following circumstances:

• Service providers: With trusted third-party companies that help us operate the App (e.g., cloud hosting, analytics, payment processing). These providers are contractually obligated to protect your data and use it only for the services we request.

Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information:

How to exercise your rights: Contact us at info@hummelmed.com or use the in-app form to submit requests. We will respond to verified requests within 45 days (or as required by applicable law).

Account deletion: You may delete your account at any time through the App settings or by contacting us at info@hummelmed.com. Upon deletion, we will remove your personal information within 45 days, except where retention is required by law.

California Residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides additional rights:

• Right to Know: You can request details about the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the third parties with whom we share it
• Right to Delete: You can request deletion of your personal information, subject to certain exceptions
• Right to Opt-Out of Sale/Sharing: We do not sell or share your personal information for cross-contextual behavioral advertising
• Right to Limit Use of Sensitive Personal Information: You can request that we limit our use of sensitive personal information to what is necessary to provide the Service

As of January 1, 2026, the CCPA requires that this Privacy Policy be accessible from both the App's download page (on the App Store and Google Play) and within the App's settings menu.

Children's Privacy

HUMMED is not directed at children under the age of 13 (or 16 in certain jurisdictions). We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately at info@hummelmed.com, and we will take steps to delete such information.

International Users

If you are accessing the App from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using the App, you consent to such transfers.

For users in the European Economic Area (EEA) or United Kingdom, we process personal data based on the following legal bases: consent, performance of a contract, legitimate interests, or compliance with legal obligations. You have additional rights under the GDPR, including the right to lodge a complaint with your local data protection authority.

Cookies and Tracking Technologies

The HUMMED App may use local storage, device identifiers, and similar technologies to enhance your experience and collect usage data. We do not use traditional browser cookies within the App, but our analytics and advertising partners may use similar technologies.

1. Introduction and Acceptance

Welcome to HUMMED. These Terms & Conditions ("Terms") govern your access to and use of the HUMMED mobile application (the "App") and all related services provided by HUMMED LLC ("Company," "we," "us," or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We recommend reviewing these Terms periodically, as your continued use of the App constitutes acceptance of any changes.

2. Definitions

For the purposes of these Terms:

• "App" refers to the HUMMED mobile application available on iOS and Android platforms
• "Content" refers to all audio tracks, text, graphics, images, and other materials available through the App
• "User," "you," or "your" refers to any individual who accesses or uses the App
• "Subscription" refers to any paid plan that grants access to premium features or content within the App
• "Service" refers to all features, functionality, and content provided through the App

3. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under 18 (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian.

4. Health and Medical Disclaimer

HUMMED IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The sound therapy content, including but not limited to binaural beats, isochronic tones, 40 Hz gamma audio, and all other audio frequencies provided through the App, is intended for general wellness and informational purposes only.

By using the App, you acknowledge and agree that:

• The App and its content are not intended to diagnose, treat, cure, or prevent any disease, medical condition, or mental health condition
• The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition
• You should consult your physician or healthcare provider before beginning any sound therapy program, particularly if you have a history of seizures, epilepsy, or other neurological conditions; use a pacemaker, hearing aid, or other electronic medical implant; are pregnant (especially in the first trimester); have a serious mental health condition; or are sensitive to sound or light stimulation
• No guarantees or promises are made regarding the results or benefits of using the App. Individual experiences may vary
• Any references to scientific studies or research within the App are provided for educational purposes only and do not constitute endorsement or proof of efficacy for any specific individual
• The information and content provided through the App have not been evaluated by the Food and Drug Administration (FDA) or any other regulatory body
• You assume full responsibility for your use of the App and any consequences thereof. You agree to immediately discontinue use and seek medical attention if you experience any adverse effects, including but not limited to headaches, dizziness, nausea, or seizures
• The Company, its officers, employees, and affiliates shall not be liable for any injury, harm, or damage resulting from your use of the App or reliance on its content

5. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, solely for your personal, non-commercial use.

This license does not allow you to:

• Sell, resell, rent, lease, or sublicense the App or any Content
• Copy, reproduce, distribute, or publicly display any Content
• Modify, adapt, translate, reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices, labels, or marks on the App
• Use the App for any unlawful purpose or in violation of these Terms
• Use automated scripts, bots, or other means to access or interact with the App

6. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to:

• Provide accurate, current, and complete information during registration
• Update your information to keep it accurate and current
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

7. Subscriptions and Payments

HUMMED may offer free and premium subscription tiers. If you choose a paid Subscription:

• Billing: Payments are processed through Stripe. By subscribing, you authorize recurring charges at the applicable subscription rate
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
• Cancellation: You may cancel your Subscription at any time through your device's App Store account settings or by contacting us. Cancellation takes effect at the end of the current billing period; no refunds are provided for partial billing periods
• Price changes: We may change subscription prices at any time. Price changes take effect at the start of the next billing period following notice to you
• Free trials: If offered, free trial periods convert to paid Subscriptions unless canceled before the trial ends

Refund policies are subject to the applicable App Store's terms and policies.

8. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Use the App to harass, abuse, defame, or threaten any person
• Attempt to gain unauthorized access to the App, other accounts, or any related systems or networks
• Introduce viruses, malware, or other harmful material
• Use the App to collect or harvest personal information of other users
• Interfere with or disrupt the operation of the App or its servers
• Use the App for any commercial purpose without our written consent

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to audio tracks, sound designs, text, graphics, logos, icons, the HUMMED brand name, and software are owned by Hummed LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store, or transmit any material from the App except as expressly permitted by these Terms.

10. User Feedback

If you provide feedback, suggestions, or ideas about the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, modify, and incorporate such Feedback into the App or our other products and services without obligation or compensation to you.

11. Third-Party Links and Services

The App may contain links to third-party websites, services, or content that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party services. You access third-party content at your own risk.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

Upon termination:

• Your license to use the App will immediately cease
• You must delete all copies of the App from your devices
• Provisions of these Terms that by their nature should survive termination shall survive (including disclaimers, limitations of liability, and governing law)

You may terminate your account at any time by deleting the App and requesting account deletion through App settings or emailing us at info@hummelmed.com.

13. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY CONTENT WILL PRODUCE SPECIFIC HEALTH, WELLNESS, OR THERAPEUTIC RESULTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUMMED LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS LESS.

15. Indemnification

You agree to indemnify, defend, and hold harmless Hummed LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.

Arbitration: Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered in Ashland, Oregon, in accordance with its rules. You agree to waive any right to a jury trial or to participate in a class action.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by email and update the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

If you do not agree with the updated Terms, you must stop using the App and delete your account.

18. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal agreements published by us in connection with the App, constitute the entire agreement between you and Hummed LLC regarding your use of the App.
